GAUGE – TERMS OF USE AND PRIVACY POLICY

I. Terms of Use 

Welcome to Gauge. These Terms of Use ("Terms" or "Agreement") form a binding legal agreement between you and Get Gauge, Inc. ("Gauge," "we," "us," or "our") and govern your access to and use of the Gauge website (www.gauge.ai), the Gauge mobile and web applications, our Living Profiles product, and all related features and services (together, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Platform.

Please Read Carefully

These Terms contain provisions that affect your legal rights. They include:

  • Functional limitations of the Platform and disclaimers of warranties.

  • Your obligation to comply with applicable laws and regulations.

  • Limitations on our liability to you.

  • A binding arbitration agreement and class-action waiver (see Section 13).

Please read the entire document, including the arbitration provision, before using the Platform.

1. Eligibility

The Platform is offered to users who are at least 13 years of age. Users between the ages of 13 and 17 may use the Platform only with the verifiable consent of a parent or legal guardian. Users in jurisdictions where a higher minimum age applies must meet that minimum age. For certain Partner engagements, participants must be 18 or older. You will only receive these surveys if you meet the age criteria.

Accounts are limited to individuals. Corporations and other business entities are not eligible. One account per person is permitted, even if you maintain multiple email addresses. Use of automated services, bots, or scrapers to interact with the Platform is prohibited.

By using the Platform, you represent and warrant that you meet these eligibility requirements and that you have the legal authority to enter into these Terms.

2. Account Registration and Security

When you apply to be a Gauger, you must provide accurate, complete, and current information, including your first name, last name, and a valid email address. You must select a password and are responsible for maintaining the confidentiality of that password and for all activity that occurs under your account.

You agree to:

  • Promptly update your account information when it changes.

  • Notify Gauge promptly at app@getgauge.com if you believe your account has been accessed without authorization, or if you discover any other security issue affecting your account or the Platform.

  • Not share your account with others or allow others to access the Platform using your credentials.

Gauge may act on instructions received under your account credentials without further verification. We are not responsible for losses or damages resulting from unauthorized access to your account through your own action or inaction.

3. Access Rights

We may modify, suspend, or discontinue the Platform, in whole or in part, at any time and at our sole discretion. We may restrict access to some or all of the Platform, with or without notice. We are not liable for any unavailability of the Platform.

We may disable any username, password, or other identifier at any time in our sole discretion, including if we determine that you have violated these Terms. Inactive accounts may be automatically closed after 1,095 consecutive days of inactivity, and any remaining incentive balance may be forfeited (see Section 6).

4. AI-Powered Surveys

Some Gauge surveys are part of our Living Profiles product, which uses artificial intelligence to synthesize Gauger responses into a representation of a consumer segment. When you participate in a Living Profiles survey:

  • Your responses will be combined with responses from other Gaugers in your panel and processed by an AI system (Google Gemini accessed through the Gemini Enterprise Agent Platform).

  • The Partner sponsoring the survey receives segment-level insights and anonymized quotes — never your individual responses connected to your identity.

  • Partners may interact with the segment-level representation conversationally over the engagement, asking new questions and exploring insights about the segment as a whole.

  • No automated decision is made about you as an individual that produces legal or similarly significant effects.

The pre-survey consent screen will provide specific disclosures about the survey and require your explicit consent before you begin. You may decline at any time without affecting your standing as a Gauger or your eligibility for other surveys.

Other Gauge research products operate under different models — including some that may involve sharing your basic personal identifiers with the sponsoring Partner. Where this applies, you will be informed and asked for your specific consent before you participate. See the Privacy Policy for details.

5. Survey Participation

Survey participation is voluntary. You are not required to accept any survey invitation, and you may decline or withdraw from any survey at any time. You may receive invitations to participate in surveys by email or by in-app push notification.

When you participate in a survey, you agree to provide truthful, thoughtful, and original responses. You will not:

  • Submit responses that are facially incomplete, duplicative, fraudulent, or that fail to meet stated minimum content requirements.

  • Use automated tools or other Gaugers' accounts to submit responses.

  • Submit responses that infringe the rights of any third party or that contain unlawful content.

  • Share survey content, links, or related materials publicly without our prior written consent.

6. Incentives

Some surveys include incentives. The amount or type of incentive will be stated in the survey invitation. Not all surveys include incentives.

Incentives are earned only for fully and truthfully completed survey submissions. You will not receive an incentive for any submission that fails to meet the survey requirements, that we reasonably determine to be fraudulent or duplicative, or that violates these Terms.

Incentives may be delivered through third-party payment processors (such as PayPal, Tremendous, or other services we may use). Incentives and account balances are not transferable, are not exchangeable for cash unless provided in cash form, and may not be auctioned, traded, bartered, or sold.

If your account is inactive for more than 1,095 consecutive days, any remaining incentive balance will be forfeited. We may also change the structure of the incentive program (for example, from cash to a points system), in which case existing balances will be converted at equivalent value.

7. Intellectual Property

"Content" refers to information, questions, text, images, and other materials provided to you through the Platform. As between you and Gauge, all Content is owned by Gauge or its licensors and is protected by copyright, trademark, and other intellectual property laws.

"User Contributions" refers to information, text, images, audio, video, and other materials you submit through the Platform — including your survey responses. You retain ownership of your User Contributions, but you grant Gauge and its affiliates, service providers, successors, and assigns a non-exclusive, royalty-free, worldwide, sublicensable, and perpetual right to use, reproduce, modify, synthesize (including via AI processing as described in Section 4), publicly perform, publicly display, distribute, and otherwise process your User Contributions for the purposes described in our Privacy Policy.

You agree not to copy, redistribute, or replicate Content outside of the Platform, and not to use Gauge's trademarks, service marks, or logos without our prior written consent.

8. Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable law or regulation.

  • Impersonate any person or misrepresent your identity.

  • Interfere with or disrupt the Platform or the servers and networks connected to it.

  • Attempt to gain unauthorized access to any portion of the Platform, to other accounts, or to any related systems.

  • Transmit viruses, worms, trojans, or other malicious code.

  • Use any scraping, data-mining, bot, or other automated method to access, monitor, or extract data from the Platform.

  • Circumvent access controls, security measures, or robot exclusion headers.

  • Take any action that imposes an unreasonable load on the Platform infrastructure.

  • Post or transmit any information that you are bound not to disclose by agreement, contract, fiduciary duty, employment relationship, or law — including insider information, trade secrets, or confidential information of any third party.

9. Monitoring and Enforcement

We reserve the right, but not the obligation, to monitor, review, edit, or remove User Contributions and to take any action with respect to a User Contribution that we deem necessary or appropriate in our sole discretion, including for violations of these Terms or applicable law.

We may disclose your identity or other information about you to a third party who claims that material you posted violates their rights or to comply with a legal request from law enforcement or other government authority. You waive and hold harmless Gauge from any claims resulting from actions we take in connection with these investigations.

10. Third-Party Links and Services

The Platform may include links to or integrations with third-party websites, applications, and services. We do not control those third parties and are not responsible for their content, operation, or privacy practices. Your interactions with third-party services are governed by their own terms and privacy policies.

11. Disclaimers of Warranty

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAUGE AND ITS AFFILIATES AND LICENSORS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

GAUGE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES, OR THAT IT WILL MEET YOUR REQUIREMENTS. AI-GENERATED OUTPUTS, INCLUDING LIVING PROFILE OUTPUTS, ARE PROVIDED AS ANALYTICAL INTELLIGENCE AND MAY CONTAIN ERRORS OR OMISSIONS. YOU SHOULD NOT RELY ON AI-GENERATED OUTPUTS AS DEFINITIVE WITHOUT INDEPENDENT VERIFICATION.

NOTHING IN THIS SECTION AFFECTS WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GAUGE AND ITS AFFILIATES AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM, WHETHER IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL GAUGE'S AGGREGATE LIABILITY UNDER THESE TERMS EXCEED ONE HUNDRED U.S. DOLLARS ($100), OR, IF GREATER, THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW. ANY CLAIM ARISING UNDER THESE TERMS MUST BE BROUGHT WITHIN ONE (1) YEAR OF THE CAUSE OF ACTION ACCRUING.

NOTHING IN THIS SECTION AFFECTS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

13. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES BINDING ARBITRATION AND LIMITS HOW YOU CAN SEEK RELIEF.

You and Gauge agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or our relationship — except where applicable law prohibits arbitration — will be resolved by binding arbitration administered by JAMS under its Comprehensive Arbitration Rules and Procedures. The arbitration will take place in New York, New York unless otherwise agreed.

Before initiating arbitration, you agree to first contact us at app@getgauge.com and attempt to resolve the dispute informally. If we cannot resolve it within 60 days, either party may proceed to arbitration.

No Class Actions. Claims must be brought in your individual capacity. You and Gauge each waive the right to a jury trial and the right to participate in a class action, representative action, or private attorney general action.

Small-Claims Exception. Either party may bring an individual claim in small-claims court if the claim qualifies.

Equitable Relief. Either party may seek injunctive or other equitable relief from a court of competent jurisdiction to protect intellectual property or to address actual or threatened breach of confidentiality.

EEA / UK Residents. If you are located in the European Economic Area or the United Kingdom, you may have additional rights to bring proceedings in the courts of your country of residence. Nothing in this section limits those rights.

14. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Gauge, its affiliates, licensors, service providers, and each of their officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your access to or use of the Platform.

  • Your User Contributions.

  • Your breach of these Terms.

  • Your violation of applicable law or the rights of any third party.

  • Your gross negligence or willful misconduct.

15. Changes to These Terms

We may modify these Terms at any time. We will post any changes on the Platform and update the effective date. Material changes will also be communicated by email to your registered account address. Changes to the arbitration provisions in Section 13 will not apply to disputes for which the parties have actual notice on or before the date the change is posted.

Your continued use of the Platform after the changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.

16. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Gauge regarding the Platform and supersede any prior agreements.

Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Severability. If any provision is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

Assignment. These Terms are personal to you and may not be transferred or assigned by you. We may assign them without restriction.

Governing Law. These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles, except that EEA/UK residents may have additional protections under their local law.

Venue. Subject to Section 13, any judicial proceedings must be brought in the state or federal courts located in Manhattan, New York, and each party consents to the personal jurisdiction and venue of those courts. EEA/UK residents may also bring proceedings in their country of residence as permitted by applicable law.

Notices. We may send notices to you by email at the address associated with your account or by posting on the Platform. You may send notices to us at app@getgauge.com.

II. Privacy Policy 

1. Overview

Get Gauge, Inc. ("Gauge," "we," "us," or "our") operates a research platform that helps brands and organizations understand consumers through survey-based research, AI-powered analysis, and segment-level insights. This Privacy Policy explains what personal information we collect from participants ("Gaugers"), how we use it, who we share it with, and the rights you have over your information.

This Privacy Policy applies to the Gauge website (www.gauge.ai), the Gauge mobile and web applications, our Living Profiles product, and all related features and services (together, the "Platform"). It also applies to information we collect from Gaugers in connection with surveys we conduct on behalf of our business partners ("Partners").

Gauge operates more than one product. The way your information is used and shared depends on which product is involved:

  • Living Profiles: an AI-powered consumer-segment platform where individual identifiers are never shared with Partners. Partners receive segment-level insights and anonymized quotes.

  • Other Gauge research products: traditional named-panel or expert-panel research where, with your specific consent, your first name, photo, and any video responses you submit may be shared with the Partner sponsoring the research.

Where this Policy treats a product differently, we say so explicitly.

This Privacy Policy is incorporated into and should be read alongside our Terms of Use.

2. Information We Collect

We collect personal information in three ways: information you voluntarily provide to us, information we collect automatically, and information we receive from third parties.

2.1 Information You Voluntarily Provide

Registration and account credentials. When you apply to be a Gauger, we collect your first name, last name, email address, country, job title, organization, photo, and any professional or social media profile link you choose to provide (for example, LinkedIn, Instagram, Twitter, Facebook, Snapchat). When your application is approved and you register an account, we also collect a password for authentication.

Demographic information. During profile completion, we may ask for additional demographic information including your gender, race, and ethnicity. Race, ethnicity, gender, and any health-adjacent information are treated as special category data under applicable law and are collected only with your separate explicit consent (see Section 6 below).

Survey responses. When you participate in surveys, we collect your responses (text, multiple choice, ratings) and any uploaded media (photo, audio, or video) you choose to submit.

Payment and rewards information. To pay incentives, we collect payment-related information such as a PayPal email or other payment identifier you provide.

Customer support and other communications. If you contact our support team, apply for a job, or otherwise communicate with us, we collect the information you choose to share — name, email, message contents, attachments, resume content.

2.2 Information We Collect Automatically

When you use the Platform, we automatically collect:

  • Location data — imprecise, generally derived from IP address (city or postal code level).

  • Device data — device type, operating system, browser, internet service provider, language settings, and device identifiers such as IP address.

  • Platform and usage information — which features you use, pages or screens visited, dates and times of activity, and referring or exiting pages.

  • Cookies and similar tracking technologies — see Section 11 for details and your options.

2.3 Information We Receive from Third Parties

We may receive information about you from:

  • Third-party service providers — for example, if you sign in using a third-party identity provider such as Facebook, LinkedIn, or Google, we may receive the information you have made available through that provider.

  • Recruitment platforms — when we recruit Gaugers through partners such as User Interviews or similar services, we receive basic contact and demographic information that you have authorized those services to share for research opportunities.

  • Partners and other third-party data sources — we may receive supplementary information such as demographic data or device identifiers from our Partners or research data providers and may combine it with information you have provided.

3. How We Use Information

We use the information we collect to:

  • Operate, maintain, and improve the Platform, including administering surveys and producing research insights for Partners.

  • Build and update Living Profile segment representations using AI-powered synthesis of survey responses (see Section 4).

  • Communicate with you about surveys you are eligible for, platform updates, incentive payments, and customer support.

  • Personalize your experience, including showing you surveys relevant to your panel and segment.

  • Pay incentives and process related transactions.

  • Detect, prevent, and respond to fraud, abuse, or security incidents.

  • Generate anonymized, aggregate data and reports that do not identify any individual Gauger.

  • Comply with applicable law, respond to lawful requests, and enforce our Terms of Use.

  • With your separate consent, send marketing or promotional communications. You may opt out at any time.

4. AI Processing and Living Profiles

Living Profiles is Gauge's AI-powered consumer-segment platform. When you participate in surveys associated with a Living Profile, your responses are processed in the following ways:

Combination and synthesis. Your survey responses are combined with responses from other Gaugers in your panel and synthesized using AI into a segment-level representation — a model of the segment's collective attitudes, preferences, and behaviors.

AI infrastructure. We use Google Gemini models (Gemini 2.5 Pro and Gemini 2.5 Flash) accessed through the Gemini Enterprise Agent Platform, which runs on Google Cloud Platform. This is a private model instance: your data is not shared with other customers and is not used in any shared environment.

Zero retention by AI provider. Under our Gemini Enterprise Agent Platform agreement, prompts and responses are processed ephemerally and are not retained by Google after processing is complete. Limited exceptions exist for safety and abuse monitoring (up to 90 days). Gauger and client data is never used to train or improve Google's foundation models.

Segment-level outputs. Partners interact with the segment-level Living Profile representation conversationally over the engagement. They receive insights about the segment as a whole — not about you as an individual.

Disclosure of automated processing. We rely on AI-powered processing as part of our service. We do not make legal or similarly significant automated decisions about you. Your participation in Living Profiles does not result in any automated decision that affects your panel membership, compensation, or other outcomes that materially affect you. Where you are a resident of the EEA or UK, you have the rights described in Section 9.

5. Information Sharing

We do not sell personal information, and we do not market third-party products directly to you based on the information you provide to us.

We share personal information in the following circumstances:

5.1 Sharing with Partners — Living Profiles

For Living Profiles surveys and the associated segment representation:

  • Aggregate, segment-level insights. Partners receive insights about the segment as a whole — not about you as an individual.

  • Anonymized text quotes. Specific text quotes from individual survey responses may appear in reports or in conversational interactions, but they are anonymized — never connected to your name, contact information, or anything that could identify you in text.

  • Video responses. Where a Living Profiles survey includes a video question, the video you submit may be visible to the Partner sponsoring the survey. Video is shared without your name, contact information, or other written identifiers attached. Your face and voice are inherently part of the video content. Submitting a video is always optional, and you can decline to submit video questions without affecting your participation in the rest of the survey.

  • No targeting or contact. Partners cannot identify, contact, or target any specific Gauger through the Living Profiles product.

5.2 Sharing with Partners — Other Gauge Products

Some Gauge research products operate under a named-panel or expert-panel model in which the value of your participation comes in part from your identifiable contributions. For those products only, with your specific consent at the point of survey participation:

  • We may share your first name, the photo you provide, and any video responses you submit with the Partner sponsoring the survey.

  • We will not share your last name, title, contact information, or other identifying details unless you specifically authorize it.

  • We share this information only with that specific Partner and do not redistribute it outside that engagement.

  • You will be informed at the start of any such survey if your contributions will be shared, and your participation requires your explicit consent.


5.3 Sharing with Service Providers

We share personal information with service providers who help us operate the Platform and our business. These include:

  • Google Cloud Platform — hosting, storage, and AI processing infrastructure.

  • Gemini Enterprise Agent Platform (Google) — AI processing for Living Profiles, under zero data retention terms.

  • Identity providers — for authentication (e.g., Google OAuth).

  • Payment processors — to deliver incentive payments (e.g., PayPal, Tremendous, or similar).

  • Recruitment platforms — to invite eligible Gaugers to participate.

  • Customer support and operational tools — used to operate our business.

Service providers process information on our behalf, subject to contractual confidentiality and security obligations, and are not authorized to use your information for their own purposes.

5.4 Legal and Safety Disclosures

We may disclose personal information when we believe in good faith that doing so is required to comply with applicable law, respond to lawful requests from public authorities, protect the rights, property, or safety of Gauge or others, or enforce our Terms of Use.

5.5 Business Transactions

If Gauge is involved in a merger, acquisition, financing, sale of assets, or similar transaction, personal information may be transferred as part of that transaction, subject to applicable law and ongoing confidentiality.

5.6 With Your Consent

We may share personal information for any other purpose with your specific consent.

5.7 De-identified and Aggregate Information

We may share de-identified, anonymized, or aggregate information — which does not identify you or your device — for any lawful purpose, including research, benchmarking, and product improvement.

6. Special Category Data and Explicit Consent

Under applicable data protection laws (including GDPR Article 9 and UK GDPR Article 9), certain categories of personal data are considered "special category data" and require a higher level of protection. These include data revealing racial or ethnic origin, health information, and similar categories.

Gauge collects the following special category data, and only with your separate, explicit consent:

  • Race and ethnicity — collected via a dedicated consent screen during profile completion. You may decline without affecting your ability to participate in surveys.

  • Gender — collected via the same dedicated consent screen.

  • Health-adjacent information — occasionally, when a Living Profile addresses a health-adjacent segment, survey responses may touch on health-related topics. In those cases, we present a separate consent screen at the start of the survey describing what is being collected and how it will be used.

Our legal basis for processing special category data is your explicit consent under GDPR Article 9(2)(a) (or the equivalent provision under UK GDPR or applicable U.S. state law).

Each consent event is recorded with a timestamp, the version of the disclosure you saw, and the specific data you consented to share. You can withdraw consent for the collection or further processing of special category data at any time from your Profile settings, by emailing app@getgauge.com (Subject: 'Privacy Request'), or by deleting your account. Withdrawal does not affect the lawfulness of processing carried out before the withdrawal.

7. Data Retention

We retain personal information only for as long as necessary for the purposes described in this Privacy Policy, or as required or permitted by applicable law. Specifically:

  • Active Gauger account data — retained for the duration of your account and panel participation.

  • Survey responses — retained for the duration of the related research engagement plus a reasonable period for verification, audit, and research integrity.

  • Living Profile grounding data — retained as long as the Living Profile is active. Upon Partner offboarding, associated data stores and AI platform assets are deleted.

  • Special category data — retained only while you maintain your consent. If you withdraw consent or close your account, we anonymize the data permanently.

  • Consent and audit logs — retained for 10 years to support audit, compliance, and dispute resolution.

  • Payment records — retained for the period required by applicable tax and financial recordkeeping rules.

When personal information is no longer needed for the purposes for which it was collected, we will delete, anonymize, or aggregate it.

8. Your Rights

Depending on where you reside, you may have the following rights with respect to your personal information. Gauge honors these rights as required by applicable law.

8.1 Rights Applicable Broadly

  • Access — you can request a copy of the personal information we hold about you.

  • Correction — you can ask us to correct inaccurate or incomplete information.

  • Deletion — you can ask us to delete your personal information, subject to legal recordkeeping requirements.

  • Withdrawal of consent — you can withdraw your consent at any time, including consent for special category data, without affecting the lawfulness of prior processing.

  • Objection or opt-out — you can object to certain processing, including direct marketing, and opt out of communications we send you.

8.2 Additional Rights for EEA / UK Residents (GDPR / UK GDPR)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, you also have the right to:

  • Restrict processing in specific circumstances (e.g., while we verify a correction request).

  • Data portability — receive your personal information in a structured, commonly used, machine-readable format and transmit it to another controller.

  • Object to processing based on legitimate interests.

  • Lodge a complaint with your local data protection supervisory authority.

8.3 California, Colorado, Connecticut, and Other U.S. State Rights

If you are a resident of California, Colorado, Connecticut, Utah, Virginia, or another U.S. state with a comprehensive privacy law, you may have additional rights including access, deletion, correction, opt-out of sale or sharing (we do not sell personal information), opt-out of targeted advertising, and opt-out of certain profiling. To exercise these rights, see Section 14.

8.4 How to Exercise Your Rights

To exercise any of these rights, email us at app@getgauge.com (Subject: 'Privacy Request'). We will respond within the timelines required by applicable law (typically within 30 days). We may need to verify your identity before fulfilling a request. We will not discriminate against you for exercising your rights.

9. International Data Transfers

Gauge is based in the United States, and personal information we collect is processed and stored on infrastructure located in the United States. If you are accessing the Platform from outside the United States, your information will be transferred to, processed in, and stored in the United States.

Transfers from the European Economic Area, United Kingdom, or Switzerland to the United States are governed by Standard Contractual Clauses (SCCs) incorporated into our Google Cloud agreement and, where applicable, supplemented by Gauge's own SCCs with our Partners under data processing agreements.

We maintain additional safeguards to protect international data transfers, including encryption in transit and at rest, access controls, and contractual restrictions on onward transfers by our service providers.

10. Cookies and Similar Technologies

We use session cookies, persistent cookies, and similar tracking technologies (such as pixel tags) on our Platform to:

  • Operate the Platform and remember your preferences and sign-in state.

  • Measure usage and performance (e.g., Google Analytics).

  • Support security and fraud prevention.

Most browsers let you delete or block cookies. Doing so may affect your ability to use parts of the Platform.

We honor recognized Global Privacy Control (GPC) signals where applicable law requires it.

11. Children's Privacy

The Platform is intended for users 13 years of age and older. Users between the ages of 13 and 17 may use the Platform only with the verifiable consent of a parent or legal guardian.

We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it as quickly as possible. If you are a parent or guardian and believe your child under 13 has provided personal information to us, please contact us at app@getgauge.com (Subject: 'Privacy Request').

For users in the EEA or UK who are below the age of digital consent set by their member state (ranging from 13 to 16), we obtain verifiable parental or guardian consent before processing personal information. Verification methods may include payment-card verification, signed consent form, or other means appropriate to the level of risk.

Partners who require participants to be 18 or older for specific engagements may apply stricter age requirements at the survey or panel level. Where applicable, we apply those stricter requirements to ensure compliance with the Partner's engagement terms.

12. Security

We use reasonable administrative, technical, and physical safeguards to protect personal information against loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. These include:

  • Encryption of data in transit (HTTPS / TLS) and at rest (AES-256).

  • Identity and access management controls (Google Cloud IAM).

  • Multi-factor authentication for personnel with privileged access.

  • Audit logging of administrative and data-access activity.

  • Documented incident response and breach notification procedures.

No security measure is perfect. If you have reason to believe that your interaction with us is no longer secure or that your account has been compromised, please contact us immediately at security@getgauge.com.

13. Breach Notification

In the event of a confirmed personal data breach affecting your personal information, we will notify you and applicable regulators without undue delay and, where feasible, not later than 72 hours after becoming aware of the breach, in accordance with applicable data protection requirements.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the effective date at the top of this policy. If we make material changes, we will provide notice through the Platform or by email to your registered account address. Your continued use of the Platform after the changes take effect constitutes acceptance of the updated Privacy Policy.
